Terms of Sale

1. Eligibility & registration

You must be 18+ and provide accurate information to register. General-public bidders authorize a refundable $100 deposit before bidding; licensed dealers may be exempt with a valid dealer license. Open Bid Auto Exchange reviews and approves bidders and may decline or suspend any account at its discretion.

2. Bidding is binding

Every bid you place is a binding offer to purchase the vehicle at that price plus the buyer's fee and applicable taxes and charges. Our system may place proxy bids up to the maximum you set. A bid placed near the end of an auction extends the closing time (anti-snipe). Bids may not be retracted except at our sole discretion.

3. Reserve & sale

Some vehicles carry an undisclosed reserve. If bidding meets the reserve (or the vehicle has no reserve), the highest bid at close wins and the sale is final. If the reserve is not met, the vehicle may not sell.

4. Buyer's fee, taxes & payment

The winning bidder pays the winning bid plus a buyer's fee of 5% (minimum $250), plus applicable sales tax, title, and license fees. The buyer's fee and deposit are payable by credit card (a 3% card fee applies) or by ACH/wire without a card fee; the vehicle balance is payable by wire, ACH, or cashier's check. Full payment is due within the timeframe stated at checkout.

5. Vehicles sold AS-IS

Unless expressly stated otherwise for a specific lot, all vehicles are sold AS-IS, WHERE-IS, with all faults and without any warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose. Condition reports, photos, videos, and grades are provided as a good-faith aid and are not warranties. Buyers are responsible for their own due diligence.

6. Disclosures

Title brand (e.g., clean, rebuilt, salvage), odometer status, and known material defects are disclosed on the lot page to the best of our knowledge. Federal and state odometer disclosure requirements apply.

7. Dispute / arbitration window

Any claim of a material undisclosed defect must be submitted in writing within the arbitration window stated for the sale. Remedies are limited as described in these terms. [Arbitration terms and window to be finalized with counsel.]

8. Non-payment & default

If a winning bidder fails to complete payment on time, the deposit may be forfeited, the account may be suspended, the vehicle may be relisted or offered to the next-highest bidder, and additional remedies may apply.

9. Transport & pickup

Buyers arrange pickup or delivery at checkout. Transport quotes provided are estimates from third-party carriers; Open Bid Auto Exchange is not the carrier and is not responsible for transit.

10. Governing law
